Terms of service

Draft This is a working draft. It has not been reviewed by a lawyer and is not yet in force. Highlighted items still need to be filled in. Until final terms are published, use of AwayDesk is by individual agreement.

1. The service

AwayDesk is an online service for recording and managing employee leave, provided by [legal name and registration number] ("we"). These terms apply between us and the business that signs up ("you").

2. Accounts

You are responsible for the accounts you create for your employees, for keeping sign-in details safe, and for removing access when someone leaves. Tell us promptly if you believe an account has been misused.

3. Your data

The leave records you put into AwayDesk belong to you. You are the responsible party for them under POPIA and we process them as your operator, only to provide the service. Our handling of personal information is described in the privacy policy. [Operator agreement terms required by sections 20 and 21 of POPIA.]

4. Leave rules and advice

AwayDesk applies the leave rules you set up. The starting rules follow the minimums in the Basic Conditions of Employment Act for a five-day week, but you are responsible for making sure your leave policy and settings match your contracts and the law. AwayDesk does not give legal advice.

5. Fees

[Pricing, billing period, payment method, trial, price changes and late payment. The price shown on the website is provisional.]

6. Availability

We aim to keep AwayDesk available at all times but do not guarantee uninterrupted service. [Support hours, planned maintenance, any service levels.]

7. Ending the service

You may stop using AwayDesk at any time. [Notice period, export of your records before closure, and how long data is kept afterwards.]

8. Liability

[Limitation of liability, to be drafted by a lawyer.]

9. Governing law

These terms are governed by the law of the Republic of South Africa.
